Return and Refund Policy

 

1. General Policy: All Sales Are Final

 

Due to the unique, antique, and highly sensitive nature of the items sold by Artemisia Fine Arts & Antiques, all sales are final and non-refundable.

We do not offer refunds, returns, or exchanges for:

  • Buyer's Remorse: If you change your mind, or the item does not fit your space or style.

  • Minor Imperfections or Wear: Any condition issues inherent to an antique, vintage, or pre-owned item, including but not limited to patina, scratches, chips, fading, or historical repairs, as detailed in our Terms & Conditions.

  • Color Variation: Differences in color or tone due to variations in monitor settings, lighting conditions, or photography.

  • Shipping Damage or Loss: Any damage, loss, or theft that occurs during the shipping process, as the risk of loss transfers to the buyer upon shipment (see Shipping Policy and Terms & Conditions).

 

2. Exception: Material Misrepresentation

 

The only exception to our "All Sales Are Final" policy is for a demonstrable case of Material Misrepresentation—meaning a significant error in the fundamental nature of the product.

A Material Misrepresentation claim will only be considered if:

  • The item delivered is a fundamentally different item than the one pictured and described (e.g., you ordered a painting, but received a chair).

  • The item's stated attribution (e.g., date, period, or artist as specified in the listing title) is proven, by a recognized, independent expert, to be grossly and materially incorrect in a manner that fundamentally alters the item's value and purpose.

 

3. Procedure for Material Misrepresentation Claims

 

If you believe your purchase qualifies as a Material Misrepresentation, you must adhere strictly to the following procedure:

  1. Notification: You must notify Artemisia Fine Arts & Antiques in writing (via email) within three (3) calendar days of receiving the item, providing detailed evidence, including high-resolution photographs, to support your claim.

  2. Authorization: Do not return the item until you receive written return authorization from us. Unauthorized returns will be refused and returned at your expense.

  3. Return Condition: Authorized returns must be shipped back to us within seven (7) calendar days of receiving authorization. The item must be returned in the exact same condition and packaging in which it was received. The item must be professionally packed and insured for its full purchase price.

  4. Return Shipping: The buyer is responsible for all costs of return shipping and insurance. These costs are non-refundable.

 

4. Inspection and Refund Processing

 

Upon receipt of an authorized returned item, we will inspect it thoroughly.

  • If the claim of Material Misrepresentation is validated and the item is in its original condition, we will process a refund for the item's purchase price (excluding original shipping costs and return shipping costs).

  • We reserve the right to refuse a refund if the item is returned damaged, altered, or if it is determined that the claim does not meet the criteria for Material Misrepresentation.
